1. About these terms

These terms cover your use of www.firstlighttec.com. The site is run by TEC Brands LLC, doing business as First Light Technologies ("First Light", "we"). By using the site you agree to them.

2. What the site is

The site describes the IBM software, hardware, cloud services and support that we sell as an IBM Business Partner. It is information, not an offer to sell. We are bound only by what is in a written quote or agreement from us.

3. Quotes and orders

A request sent through the site is a request, not an order. We answer with a written quote, and we aim to do so within one business day. The quote states its price, its terms and how long it stands.

An order exists once you accept a quote in writing and we confirm it, or once you accept an offer on a marketplace. Today the site itself does not take orders or payment.

4. IBM products and IBM's terms

IBM software, hardware and cloud services come with IBM's own license and service terms. Those terms and your quote govern your use of the product. We make no promise about an IBM product beyond what IBM's terms and our quote say.

5. Cloud marketplaces

A purchase through AWS Marketplace, Microsoft Azure Marketplace or Google Cloud Marketplace is also governed by that marketplace's terms and by the offer you accept there. Whether a purchase counts toward your committed cloud spend is decided by your cloud provider under your agreement with it.

6. Trials

Not every IBM product has a trial. IBM sets whether one is available and how long it runs, and may change either. A trial can come with its own IBM terms.

7. Dates and facts on the site

We work to keep the site accurate. IBM changes product names, support dates and availability, and the site can lag behind. Each IBM support date on the site links to the IBM page it came from and shows when we checked it. Where the site and IBM's page differ, please rely on IBM's page.

8. Briefing centers

The briefing centers on the map are meeting locations run by other companies. We use them by appointment. A location, room and time are set only when we confirm your appointment in writing, and locations can change.

9. Trademarks

IBM, the IBM logo and the names of IBM products are trademarks of International Business Machines Corporation. AWS, Microsoft Azure and Google Cloud are trademarks of their owners. First Light Technologies, FLT and the First Light mark are trademarks of TEC Brands LLC.

We are an independent IBM Business Partner. We are not IBM, and IBM does not run this site.

10. Using the site

You may read, print and share these pages for your own business. Please do not copy the site for resale or interfere with how it runs. Please send requests only for your own company, or with its approval, and not by automated tools.

The words and design of the site belong to TEC Brands LLC. IBM's material belongs to IBM.

The site links to IBM's pages and to cloud marketplaces. We do not run those sites and are not responsible for them.

11. No warranty, and limits on liability

The site is provided as it is. As far as the law allows, we give no warranty about the site. We are also not liable for indirect or consequential loss that comes from using it.

Nothing here limits what we owe you under a quote you have accepted or an agreement we have both signed, or any liability the law does not let us limit.

12. Governing law

Massachusetts law governs these terms. A dispute about the site goes to the state or federal courts in Massachusetts.

We post any change on this page and change the date at the top. Using the site after a change means you accept it. Our Privacy Policy says what the site collects.
